At M/s. Baba Nanak Tour and Travel Pvt. Ltd.(“Us”), i.e. the company owning the website www.bookcabsonline.com (“website”) we endeavor to put your comfort, ease of use, security, safety and privacy first.

 

The present Terms and Conditions of Use govern your visiting our website, mobile application, browsing through or using/ availingOur service(s).

 

The present Terms and Conditions of Use shall be read harmoniously with and shall be in addition to Our Privacy Policy, contents of which shall be read as part and parcel to these Terms and Conditions.

"Registration" shall mean the filling of registration details by User on and its acceptance by our website/ mobile application for availing Services.

"RBI" means the Reserve Bank of India.

 

"Services" shall meanthe booking, availing, travelling by or any other use of Our vehicle(s) through Our website or mobile application or through any other mode.

 

Use” shall mean and include Visiting/ Browsing/ Using/ Downloading Our Website/ Mobile Application or Browsing through or availing Services through Our Website or Mobile Application.

 

"User" shall mean and include any person or entity Visiting/ Browsing/ Using Our Website/ Mobile Application or Browsing through or availing Our Website or Mobile Application. User is also used synonymously to “You/ Your”.

 

Any definitions which are not found here shall have the same meaning as in the Privacy Policy.

 

User(s) competent or eligible to Use Our Services

Only User(s) who are aged 18 years or above and who are permitted under applicable and prevailing Laws to enter into contract shall be competent or eligible to Use Our Services. Any User who is incompetent or ineligible to Use Our Services may attract penal action, termination of Services/ Registration and such Use is not permitted by Us.

 

User(s) who are legally permitted to Use Our Services for minors, may do so on their registration, if the same is permissible by Laws.

 

The identity of the User is ascertained only from the Information provided by the User and any Use by incompetent or ineligible User shall not make Us liable to any action.

 

Not with standing anything contained under these Terms and Conditions or other terms of use or policies, Your Use of Our website/ mobile application/ Services shall be subject to exercise of Our discretion to terminate Yourregistration or block Your Use/ Registration,if Your Use/ Registration is found by Us to be incompetent or ineligible or illegal or having provided wrong Information or any other reason.

 

Registration

Registration shall be You being allotted a customer ID after You fill in Your Information or data as may be required while accessing the link ‘Registration’ which may exceed the KYC norms of RBI regulations. Each User shall only be allowed to have one Registration for his Information.


You are solely responsible for maintaining the confidentiality of Your Registration Data and will be liable for all activities and transactions that occur through Your Account on the Site, whether initiated by You or any third party. The password and other details of the Account should not be shared with any third party. Your Account is non-transferable and is not capable of being sold to a third party. We shall not be liable for any loss that You may incur as a result of someone else using Your password or Account, either with or without Your knowledge.

 

You hereby expressly consent to receive communications including promotional content from Us through Your registered phone number and/or e-mail id. You consent to be contacted by Us via phone calls/SMS notifications/emails. You agree that any communication so received by You from Us will not amount to spam, unsolicited communication or a violation of Your registration on the national do not call registry.

 

In case, You are unable to access Your Account, please inform Us at 
info@bookcabsonline.com  and make a written request for blocking Your Account. We shall require atleast 72 (Seventy Two) hours to process your request unless in case of Force Majeure (as defined hereinafter) events. In any case, We will not be liable for any unauthorized transactions made through Your Account prior to blocking of Your Account by Us in the manner provided hereinabove.

 

Use

That Your Use of the website or mobile application or Services shall be restricted to and strictly for Registration and Use as defined hereunder and You undertake, represent, confirm and declare that You shall not do any act/ deed/ thing that may be an attempt to or amount/ lead to any advertisement/ commercial activity/ benefit to Youthat is not a direct result of or is directly resulting from the availingOur Services unless permitted in writing by Us.

 

You shall not do any act, deed or thing that is or may be construed as immoral/ illegal/ phishing etc. You shall not access any Information that belongs to Us, Our associates, third party sponsors or that may belong to any third party for any reasons whatsoever.

 

You shall not use Our website or mobile application for posting Your comments/ feedback/ testing Our system/ copying its content or similar acts.

 

You hereby indemnify and agree to keep Usindemnified for any loss (actual or notional), damages, claims, liabilities etc. that may arise or may have arisen due to any breach of Ourterms and conditions or policies.

 

Use of Services

That all Services shall be used as per these terms and conditions and applicable Laws and in good faith.

 

System Requirements

 

Using the Services requires access through compatible devices, software, wireless mobile data services, and Internet access with a compatible ISP (broadband is required for web applications), none of which are included as part of the Services. You are responsible for obtaining and paying for these devices and other services, and your use of them will be subject to the terms and conditions of their respective providers. Certain combinations of hardware, software and/or Internet access may affect your use of the Service. High-speed Internet access is recommended.

 

Terms and Conditions for Cab Usage

 

1.    That the Services shall be available as:

Following Five simple steps:-

a.    Choose the desired option you are looking to book a cab ( i.e. outstation/ local/ transfer) 

b.    Enter the From (booking city), To (destination looking for), Pickup location , Date and Time.

c.    Select the vehicle of your preference with different rates;

d.    Register with your personal details with us (as mention earlier we undertake that you are obligated to provide the most recent, true and relevant Information).

e.    Then pay 20% or full estimated amount using debit cards / credit cards / Net Banking / ATM Cards and rest of the balance amount had to be paid cash directly to the driver.

 

2.    The customer shall pay the taxi fare, parking charges, additional night charges (where applicable) and any fee or levy presently payable or hereinafter imposed by the law or required to be paid for availing of the taxi Services

3.    You shall maintain reasonable behavior while utilizing the Services offered by the driver or service provider.

4.    You shall take full responsibility of your items. In case of lost items during the journey, We will try to locate the items on a "best-effort" basis but We shall not be responsible for the same in case of any losses or damages arising out of such lost items.

5.    The customer shall ensure that he/she will not indulge in any of the following activities while in a taxi


a.    Smoking or consuming any kind of intoxicants inside the Taxi. The driver has the right to refuse the pick-up or ask the customer to alight the cab if the customer is found to be in an intoxicated state or is found misbehaving with other passengers or the driver, or is causing a nuisance;


b.    Pressurize the driver to overload the boot space of the Vehicle with luggage. (The Customer shall not be generally allowed to use the seating area of the Vehicle for placing any kind of luggage)


c.    Littering the Taxi;


d.    Soiling or damaging the seats and/or any other interiors of the Taxi;


e.    Asking the driver to break any Traffic/Transport/City Police and/or government rules for any purpose (especially reaching the destination earlier).


f.     Asking the driver to board more passengers than the seating capacity in the taxi. The driver has the right to refuse such a pick-up such customer(s).


6.    If any passenger misses the train or flight or bus, Company will not be liable for any compensation, only customer is responsible for managing his trip/travel timely. The customer shall make an alternate arrangement if the cab has not reached due to any reason.

7.    If the Customer leaves any goods in the taxi or has any complaint in respect of the Services or the use of the taxi, the Customer has to inform Company of the same in writing within 12 hours of using the taxi or the Services of Company.

 

8.    The Company shall not be liable for any conduct of the drivers of the taxis. However, the Company encourages you to notify it of any complaints that you may have against the driver of any taxi that you may have hired using the Company's Services.

9.    It is expressly made clear to you hereby that the Company does not own any taxis nor does it directly or indirectly employ any drivers for the taxis. Taxis and drivers are all supplied by third parties and the Company disclaims any and all liability in respect of the drivers and the taxis alike.


10. The Company shall be entitled at any time without giving any reason to terminate the booking of taxis booked by the Customer or can provide an equivalent or a higher category of car for the same.


11. Company has the right to make changes on certain bookings where rates are applicable on days basis and shall advice the customer for the changes in fare even after advance is paid and shall  cancel the booking if customer doesn’t agrees and return the advance to the same account or card or mode which had made the payment of booking.


12. The taxi will not be driven on unpaved roads or where driving is threat.

 

Booking

For booking a cab you need to book a cab at least 3 hours prior to the reporting time. At bookcabsonline.com you can book a cab by browsing our website or mobile application, you have to go through Five simple steps:-

a.    Choose the desired option you are looking to book a cab ( i.e. outstation/ local/ transfer) 

b.    Enter the From (booking city), To (destination looking for), Pickup location , Date and Time.

c.    Select the vehicle of your preference with different rates;

Pricing Structure


Outstation Usage:

1.    Per KM Rate: This is base rate which will be charged on every km travelled. The rate varies with car model and city.

2.    Minimum KM charged per day: We charge minimum distance of 250 kms per day for each city on average basis. (i.e.: If you use the cab for 5 days then minimum you have to pay for 250 * 5 = 1250kms if the total kms travelled is less than 1250 kms so you have to p[ay for 1250 kms of if total distance travel is more than 1250kms so you have to pay for the actual kms running calculated at the end of the journey. 

3.    Daily Driver allowances: For outstation travel customers need to pay driver allowance. The allowance which may vary from cab to cab or destination to destination.

4.    Night Charge:  This is the allowance paid to driver if the driver drives the cab between 10 pm to 5 am.

5.    Toll, parking and State Tax: These are the charges paid by the customer at every toll tax/ chungi crossed during the journey, parking is the amount charged while the cab is parked during the journey time, state tax is the amount of tax paid during the journey while entering the other states.

6.    Definition of a day: Day is defined as calendar day i.e. 12 midnight to next day 12 midnight for all the calculation purposes.

7.    Service Tax: As per the Govt. of India advisory 5.8% of total trip cost is charged as service tax for each and every single trip where services are used by the customer.


Local Usage


40 km and 4 hrs:

1.    Base Fare: This is fixed fare which is charged for this service where there no extra km or no extra hrs is charged.

2. Parking charges: These are the charges paid by the customer when the cab is parked during the journey time, state tax is the amount of tax paid during the journey while entering the other states.

5.    3.    Service Tax:  As per the Govt. of India advisory 5.8% of total trip cost is charged as service tax for each and every single trip where services are used by the customer. 


80 km and 8 hrs:

1.    Base fare: This is fixed rate which will be charged for 80 km and 8 hrs.

2.    Extra km: In case the actual travel is more than 80 km then a specific amount mentioned will be charged per km travelled more than 80 km.

3.    Extra hour: In case the actual hours are more than 8 hrs then a specific amount mention will be charged pre hrs after 8 hrs.

4.    Toll, Parking and State Tax charges: These are the charges paid by the customer at every toll tax/ chungi crossed during the journey, parking is the amount charged while the cab is parked during the journey time, state tax is the amount of tax paid during the journey while entering the other states.

5.    Night Charge:  This is the allowance paid to driver if the driver drives the cab between 10 pm to 5 am.

6.    Service Tax: As per the Govt. of India advisory 5.8% of total trip cost is charged as service tax for each and every single trip where services are used by the customer.

 

Transfer


Per KM Rate: This is base rate which will be charged on every km travelled. The rate varies with car model and city.

2.    Minimum Pricing: This is the minimum fixed amount charged while travelling if the actual amount is less than the total km travelled multiply by per km rate. (i.e if you travel for 10 km and per km rate is Rs. 20/- per km and fixed rate is Rs.350/- so Rs.350/- is charged.

3.    Service Tax: As per the Govt. of India advisory 5.8% of total trip cost is charged as service tax for each and every single trip where services are used by the customer.

 

  

 

Data, code and contents of our website and mobile application

That all data, code, contents etc. of Our website and mobile application are Our registered legal property and propriety,no part of the same may be tampered with, copied,reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmittedor distributed in any way.

 

Terms and Conditions of Cancellation of Services and Refund

Cancellation, if any, must be made, notified and communicated to Usimmediately.

 

Cancellation can be made via Our website or mobile application. However, the same shall be subject to the following:

a) If done at least 72 hours prior of booking time; no cancellation fee shall be charged.

b) If done between 48-72 hours prior of booking time; 20% of booking fee amount shall be charged as cancellation fee.

c) If done between 24-48 hours prior of booking time; 50% of booking fee amount shall be charged as cancellation fee.

d) If done between 0-24 hours prior of booking time; 100% of booking fee amount shall be charged as cancellation fee.

 

Refunds, if any, shall be made from booking amount(s) within 72 hours of such cancellation being accepted by Us to the same account or card or mode which had made the payment of booking.

Limitation of Liability

All or any direct or indirect liability arising out of or in connection with the trip

and/or as a consequence of misuse of the application, delays caused to a User, losses (financial and otherwise), injury or death occurring during the Ride shall be the sole responsibility of the Users. Bookcabsonline.com shall not be a party to any dispute and/or claims arising in connection with the trip offered and availed through the website or mobile application.

 

Liabilities, if any, arising or accruing to Us towards You for any reason whatsoever, shall be limited to a maximum sum of Rs.1,000/- (Rupees One Thousand Only).

 

Force Majeure

Any Force Majeure event i.e. any event which is beyond Our reasonable control, including, without limitation, unavailability of any communication system, sabotage, fire, flood, earthquake, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war or acts of government, which may hinder or cause interruptions or hindrance or termination of/ toYour Use of Our website or mobile application shall suspend/ terminate/ absolve Us ofOur obligations, as they may be, towards You for so long as the Force Majeure Event continues, without any liability, claim or right against Us.

These terms and conditions shall be governed by and construed in accordance with the laws of India and courts at New Delhi only shall have exclusive jurisdiction over any dispute, difference, controversy, proceedings, or claim of whatever nature arises at any time under, out of, in connection with or in relation to these terms and condition including, without limitation, any dispute, difference, controversy, proceedings, or claim relating to the validity, interpretation, construction, performance and enforcement of any provision of these terms and conditions or the breach, termination or invalidity thereof.
